Welcome to Wow! Fitness Music, the Fitness Division of Kryon Records Company. The following is a binding agreement between you and Wow! Fitness Music for your use of the services provided on Wow! Fitness Music. If you visit or shop at Wow! Fitness Music, you accept these terms and conditions.
In these conditions:
"Company", "We", "Our", "Us", "Site", "Wow! Fitness and Wellness Music", "Wow! Fitness and Wellness", "Wow! Fitness Music", "Kryon Records" or "Kryon Records Company" means Kryon Records Company situated at Campillo 3042 Dto D, C.A.B.A, Postal Code: C1427DCN, Argentina.
"You" means the customer who visit our website or/and place an order with the Company and whose order is accepted by the Company.
"Digital Content" means CDs, MP3 Downloads, OGG Vorbis Downloads, Videos, Pictures, Images, texts, and all the content on Wow! Fitness Music Site and all Kryon Records Company Sites.

2. Electronic Communications
When you visit Wow! Fitness Music, Kryon Records Company or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
3. The Service.
Wow! Fitness Music and Kryon Records Company offers videos, CDs, downloads of digitized versions of audio recordings, artwork and information relating to such audio recordings, and other contents like free information, pictures, images, books, etc (individually and collectively, "Digital Content"). The Sites allows you to listen to audio clips before buying and obtain downloads of sound recordings (Albums) and other related materials (Materials). These terms and conditions may be amended at any time by Kryon Records Company. Any amendments will be posted on the Kryon Records Company website and the Wow! Fitness Music website. You should always review the Terms & Conditions regularly to ensure you are aware of any such changes.
4. Limitations of Usage & Copyright.
4.1 Rights Granted. After you purchase any of our Products you may copy, store, transfer and burn the Digital Content only for your personal, non-commercial, entertainment use, subject to and in accordance with the Terms of Use.
4.2 Restrictions. You represent, warrant and agree that your use of the Digital Content is limited to your own personal use and the Digital Content shall not be commercially exploited by you in any way and is subject to Kryon Records Company's Usage Rules which you hereby agreed to. You acknowledge that you need a Public Performance License (PPL) for using the Digital Content in commercial environments and that you are responsible for getting it. You will not use the Digital Content for any redistribution of the Digital Content or other use restricted in this Section 4.2. You agree not to infringe the rights of the Digital Content's copyright owners and to comply with all applicable laws in your use of the Digital Content. Except as set forth in Section 4.1 above, you agree that you will not redistribute, transmit, assign, sell, broadcast, rent, share, lend, modify, adapt, edit, license or otherwise transfer or use the Digital Content. You are not granted any synchronization, public performance, promotional use, commercial sale, resale, reproduction or distribution rights for the Digital Content. You acknowledge that the Digital Content embodies the intellectual property of Kryon Records Company and a third party and is protected by law.
4.3 All Sales Are Final. We will NOT issue refunds. All sales of Digital Content and all our productsare final. We do not accept returns of any of our products nor Digital Content.
4.4 Downloading and Risk of Loss. Once you have purchased Digital Content, we encourage you to download it promptly and to make back-up copies of it.
It is your responsibility not to lose, destroy, or damage the Product, and Kryon Records Company shall be without liability to you in the event to any loss, destruction, or damage. If you are unable to complete a download after having reviewed our online help resources, please contact Wow! Fitness Music by the email form. You bear all risk of loss after purchase and for any loss of Digital Content you have downloaded, including any loss due to a computer or hard drive crash.
4.5 Availability of Digital Content. We may, from time to time, remove Digital Content from the Service without notice.
4.6 Defective CD's and other products: If any of our products recently purchased from us is defective, please return it back to us as soon as possible. We will replace it with the same item inmediatly.
8. Indemnity and Waiver
By using this service you agree to indemnify and hold harmless Kryon Records Company and its agents, representative, employees, Licensors, content and technology providers, and any parent or subsidiary company from any and all losses, claims, demands, causes of actions and judgements (including legal fees on an indemnity basis and court costs) which arise out of your breach of the Agreement or use of the Service.
You shall not sue or seek to recover any damages or other payment from Kryon Records Company and its agents, representative, employees, Licensors, content and technology providers, and any parent or subsidiary company as a result of its decision to terminate or suspend this Agreement and service.
9. Disclaimer
By agreeing to the terms of the Agreement you accept that your use of the Site and the services contained therein is at your own risk. The Site and all content on it are provided as is and as available and without warranties of any kind either express or implied. This shall include (but not be limited to) all implied warranties of fitness for purpose or merchantability to the extent permitted by law.
Kryon Records Company shall use all reasonable efforts to protect the information submitted by you but you hereby acknowledge and accept that your submission of such information is at your own risk and no liability shall attach to Kryon Records Company for any loss or liability to you relating to such information.
Whilst Kryon Records Company will make all reasonable efforts to ensure an interrupted service Kryon Records Company does not make any guarantee represent or warrant that your use of the Site will be uninterrupted and without error and you recognise that Kryon Records Company may temporarily suspend the service from time to time without notice to you in order to undertake essential Site maintenance.
Whilst Kryon Records Company will make all reasonable efforts to ensure that the Site will be free from viruses, corruption or loss or other security breaches and Kryon Records Company makes no warranties in this regard and shall not be liable for any loss relating thereto.
13. Law
This Agreement shall be interpreted in accordance with the laws of Argentina and the Court of Justice in Argentina shall be the exclusive court of jurisdiction.
